CUSTOMS TARIFF

Technical Amendments Regulations (Customs Tariff) 2003-1

The Minister of Finance, pursuant to section 13 of the Customs Tariff (see footnote a) , hereby makes the annexed Technical Amendments Regulations (Customs Tariff) 2003-1.

TECHNICAL AMENDMENTS REGULATIONS
(CUSTOMS TARIFF) 2003-1

AMENDMENTS

1. The List of Tariff Provisions set out in the schedule to the Customs Tariff (see footnote 1)  is amended as set out in Part 1 of the schedule to these Regulations.

2. The List of Tariff Provisions set out in the schedule to the French version of the Act is amended as set out in Part 2 of the schedule to these Regulations.

COMING INTO FORCE

3. These Regulations come into force on the day on which they are registered.

SCHEDULE

PART 1
(Section 1)

AMENDMENTS TO THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 8415.81.10 is amended by replacing the reference to "56,868 kJ;" and "125,110 kJ" with a reference to "15.8 kW (53,900 BTU per hour);" and "34.8 kW (118,700 BTU per hour)", respectively.

2. The Description of Goods of tariff item No. 8415.82.10 is amended by replacing the reference to "6,330 kJ;" with a reference to "1.8 kW (6,000 BTU per hour);".

3. The Description of Goods of tariff item No. 8415.82.91 is amended by replacing the reference to "20,852 kJ;", "255,906 kJ;", "56,868 kJ;", "170,604 kJ;" and "125,110 kJ" with a reference to "5.8 kW (19,800 BTU per hour);", "71.1 kW (242,700 BTU per hour);", "15.8 kW (53,900 BTU per hour);", "47.4 kW (161,800 BTU per hour);" and "34.8 kW (118,700 BTU per hour)" respectively.

PART 2
(Section 2)

AMENDMENTS TO THE FRENCH VERSION OF THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 7220.20.10 is amended by replacing the reference to "De type 321 ou contenant en poids 18 % ou plus mais n'excédant pas 22 % de nickel et de chrome, d'une épaisseur n'excédant pas 2,3 mm, devant servir à la fabrication de tubes ou de tuyaux" with a reference to "De type 321 ou contenant en poids 18 % ou plus mais n'excédant pas 22 % de nickel ou de chrome, d'une épaisseur n'excédant pas 2,3 mm, devant servir à la fabrication de tubes ou de tuyaux".

2. The Description of Goods of tariff item No. 7314.13.10 is replaced by the following:

---Utilisés comme courroies transporteuses

3. The Description of Goods of tariff item No. 9993.00.00 is amended by replacing the reference to "(iv) occasionne ou peut occasionner une interruption de l'acheminement des denrées, ressources ou services essentiels." with a reference to "(iv) occasionne ou peut occasionner une interruption de l'acheminement des marchandises, ressources ou services essentiels.".

REGULATORY IMPACT
ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

The Technical Amendments Regulations (Customs Tariff) 2003-1 amends the List of Tariff Provisions set out in the schedule to the Customs Tariff. The amendments correct minor, technical errors (i.e., typographical, translation or transposition errors) identified by the Standing Joint Committee for the Scrutiny of Regulations.

Other technical amendments are being made to the wording of three tariff items to better reflect terminology commonly used by industry in measuring performance of air conditioners. These are unrelated to the amendments resulting from the Committee's work.

Alternatives

No alternatives were considered. A regulation pursuant to section 13 of the Customs Tariff is the appropriate method in this instance of correcting technical errors inadvertently introduced into the Schedule to the Customs Tariff.

Benefits and Costs

Since the amendments contained in this Regulation are minor, technical changes, they will have no impact on existing policy. They also have no financial implications for Canadian manufacturers or importers.

Consultation

As these amendments are technical changes and do not involve any new policy or financial implications which could have an impact on Canadian manufacturers or importers, no consultations were undertaken.

Compliance and Enforcement

Compliance is not an issue. The Canada Customs and Revenue Agency is responsible for the administration of the customs and tariff legislation and regulations.
