CUSTOMS TARIFF

Order Amending the Schedule to the Customs Tariff, 2003-1

Her Excellency the Governor General in Council, on the recommendation of the Minister of Finance, pursuant to section 82 of the Customs Tariff (see footnote a) , hereby makes the annexed Order Amending the Schedule to the Customs Tariff, 2003-1.

ORDER AMENDING THE SCHEDULE TO THE CUSTOMS TARIFF, 2003-1

AMENDMENTS

1. Tariff item Nos. 3801.30.00, 5513.22.00 and 5514.22.00 in the List of Tariff Provisions set out in the schedule to the Customs Tariff (see footnote 1)  are repealed.

2. The List of Tariff Provisions set out in the schedule to the Act is amended as set out in Part 1 of the schedule to this Order.

3. The List of Tariff Provisions set out in the schedule to the English version of the Act is amended as set out in Part 2 of the schedule to this Order.

4. The List of Tariff Provisions set out in the schedule to the French version of the Act is amended as set out in Part 3 of the schedule to this Order.

5. The List of Tariff Provisions set out in the schedule to the Act is amended by adding, in numerical order, the tariff provisions set out in Part 4 of the schedule to this Order.

6. Tariff item Nos. 5513.22.00 and 5514.22.00 in the List of Intermediate and Final Rates for Tariff Items of the "F" Staging Category set out in the schedule to the Act are repealed.

7. The List of Intermediate and Final Rates for Tariff Items of the "F" Staging Category set out in the schedule to the French version of the Act is amended by replacing the reference to "5514.19.90" with a reference to "5514.19.00".

8. The List of Intermediate and Final Rates for Tariff Items of the "F" Staging Category set out in the schedule to the Act is amended by adding, in numerical order, the tariff items set out in Part 5 of the schedule to this Order.

COMING INTO FORCE

9. (1) Subject to subsection (2), this Order comes into force on the day on which it is registered.

(2) Sections 3 and 7 are deemed to have come into force on December 12, 2002.

PART 1
(Section 2)

AMENDMENTS TO THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 3911.90.10 is amended by adding, in alphabetical order, a reference to "Paratertiobutyl phenol disulfide polymer for use in the manufacture of rubber pneumatic tires;".

2. The Description of Goods of tariff item No. 5503.90.10 is amended by adding, in alphabetical order, a reference to "Solely of poly (phenylene sulphide) fibres for use in the manufacture of staple fibre yarn;".

3. The Description of Goods of tariff item No. 8439.20.10 is amended by adding, in alphabetical order, a reference to "Forming station or resin blender for use in the manufacture of strawboard;".

4. The Description of Goods of tariff item No. 8462.21.91 is amended by replacing the reference to "Straightening machines" with a reference to "Straightening machines, excluding those which straighten rotationally symmetrical mass-produced parts such as bolts, screws, valves, axles and the like".

PART 2
(Section 3)

AMENDMENT TO ENGLISH VERSION OF THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 5512.29.10 is amended by replacing the reference to "for use in retractable awnings or sun umbrellas" with a reference to "for use in the manufacture of retractable awnings or sun umbrellas".

AMENDMENT TO FRENCH VERSION OF THE LIST OF TARIFF PROVISIONS

1. The Description of Goods of tariff item No. 5111.11.20 is amended by replacing the reference to "Autres, contenant un type générique" with a reference to "Autres, ne contenant pas plus d'un type générique".

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Order.)

Description

The Order Amending the Schedule to the Customs Tariff, 2003-1, removes the tariff on: certain woven fabrics for use in the manufacture of uniform or hiking pants and shorts or bicycle touring shorts; soderberg paste for use in the manufacture of silicon metal; paratertiobutyl phenol disulfide polymer for use in the manufacture of rubber pneumatic tires; poly (phenylene sulphide) fibres for use in the manufacture of staple fibre yarn; forming station resin blender for use in the manufacture of strawboard; and numerically controlled straightening machines which straighten mass-produced parts. It also rectifies an error of omission in the text of tariff item Nos. 5111.11.20 (French only) and 5512.29.10 (English only), and provides for a technical amendment to correct a typographical error in tariff item No. 5514.19.00 (French only) of the Customs Tariff.

Alternatives

No alternatives were considered as it has been a longstanding practice to use Order in Council authority to reduce or remove customs duties on goods used in the production of other goods. An order made pursuant to section 82 of the Customs Tariff is the appropriate and timely method to assist Canadian manufacturers in competing more effectively in both the domestic and export markets and to make technical amendments to previous Orders of this nature.

Benefits and Costs

This Order is consistent with existing policy and it is estimated that the revenue foregone to the Government as a result of this Order will be $246,600 annually.

Consultation

Detailed consultations were undertaken with all interested parties that were foreseen to be affected by the proposed tariff reductions. Given the nature of the proposed technical amendments, which are not expected to have any material impact on importers, no consultations were undertaken.

Compliance and Enforcement

Compliance is not an issue. The Canada Customs and Revenue Agency is responsible for the administration of customs and tariff legislation and regulations.
