Release of Civil Aviation Personnel to ICAO
and Foreign States

Policy Objective:

To outline the conditions and policies governing the release of Civil Aviation employees to participate in ICAO and Foreign States’ programs.

Background:

ICAO Assembly Resolution A29-13, calls on States to provide financial and technical resources to assist developing States in carrying out their safety oversight responsibilities. In keeping with the Resolution, Canada has been providing technical and financial assistance including the assignment of Civil Aviation employees from its operating budgets.

While the personal development and organizational benefits of these assignments are recognized, the challenge for Civil Aviation managers has been to mitigate the impact that the loss of technical expertise has had on domestic program performance, particularly during times when the pool of expertise is in short supply.

This directive will clarify the conditions governing the release of Civil Aviation employees to participate in the various programs of ICAO and assignments to foreign states and will identify the procedures to follow in order to have a consensus on the release of the employees between host and home organization.

Policy Statement:

Civil Aviation supports the release of its employees on assignments to ICAO and Foreign States provided that it can continue to meet its own critical program targets and providing the following priorities and conditions are met:

Priorities:

  1. Civil Aviation activities for domestic programs;
  2. ICAO Committees, Panels, Working and Planning Groups;
  3. ICAO Universal Safety Oversight Audit Program (IUSOAP);
  4. ICAO Technical Cooperation Program;
  5. GEASA, China (COSCAP-NA and NAAT)
  6. Individual Foreign States Priorities (ICAO Resolution A29-13);

Application:

The Policy applies to all Civil Aviation Headquarters and regional employees applying for assignments with ICAO and foreign states.

General Conditions:

Requests for assignments and assignment extensions will be considered on a case-by-case basis to reflect Civil Aviation priorities.

Related leave of absence requests are to be for less than 6 months or greater than 12 months and, except under special circumstances, approved by the Director General. All CAD 24 assignments during the employee’s career are not to exceed 3 years.

Where Civil Aviation identifies a benefit from foreign assignment experience, it commits to continuing the contribution to the employee’s superannuation payments for a maximum of 12 months over the employee’s career. For those employees currently on assignment who have already exceeded the 12-month limitation, the payments for this entitlement will stop as of November 30, 2006. This Superannuation benefit will not apply when it is known that the employee is not intending to return to TC upon completion of the assignment.

The process and responsibilities related to this CAD are listed in an associated SOP , which is available for review through RDIMS #1929272 . The content in this SOP is in accordance with the requirements of the Human Resources Policies and Ministerial Delegation of Authorities.
