Rules Amending the Bankruptcy and Insolvency General Rules SOR/DORS/2007-61
The OSB would like to inform you of the coming into force of the Rules Amending the Bankruptcy and Insolvency General Rules. The Rules were amended in order that they comply with amendments already made to the Bankruptcy and Insolvency Act. These technical amendments are intended to ensure the harmonization of federal law with Quebec civil law.

Trustee Electronic Record Keeping (TERK) Pilot Project Launch May 2007
The Office of the Superintendent of Bankruptcy (OSB) launched a pilot project in collaboration with a trustee firm to evaluate the feasability of electronic storage of insolvency files.

Reminder letter to Trustees on updates to 2007 ABR
Letter reminding all trustees of Annual Banking Report (ABR) and important updates for 2007, to provide the OSB with all Estates funds and banking information by May 31th, form at Schedule 3. Directive 5R2 came into force on April 3, 2006.

CRA Message for Trustees April 2007
The OSB is transmitting this message on behalf of CRA. CRA advises that some of the automatic updates that were applied to GST/HST credit accounts (to direct a cheque to the debtor rather than to the trustee where the trustee advised CRA that they no longer had an interest in receiving the GST/HST credit payment) were inadvertently removed. CRA has identified the affected accounts and updates will be reset automatically.

Amendments to Forms and Directives
The Office of the Superintendent of Bankruptcy has made a number of amendments to both the forms and directives as a result of three separate initiatives. These initiatives deal with modifications to some forms to facilitate their electronic transmission, updating them to comply with harmonization legislation, and replacing the term “Division Assistant Superintendent” in the directives given the OSB’s organizational renewal exercise.

Referral Agreements between Trustees and a Third Party
Many Trustees and CAIRP are concerned about the ethics regarding referral agreements entered into by Trustees with various individuals or business such as Credit Counselling Agencies, financial counsellors or even sometimes another trustee who has been prevented from filing new estates through conservatory measures, their unfairness and their non compliance with legislation.

The OSB has prepared a position paper regarding the treatment of Alberta Resource Rebates in the bankruptcy context.

Bill C-55 receives Royal Assent
Bill C-55 received royal assent. The Industry Minister assures that it will not be proclaimed in force before June 30, 2006, to allow for further legislative and regulatory amendments. The OSB is assessing the regulatory and operational changes and will post them on our website to seek stakeholders’ views.
