"In recent decades a new international awareness recognizes the rights of indigenous peoples and emerging standards provide them with a measure of protection. The full respect of their cultural, social and economic rights at both the national and international levels, however, still lies in the future.
The cultural rights of indigenous peoples, based on their distinctive characteristics, should be included in the Convention on Cultural Diversity. A set of rights and principles regarding indigenous peoples and communities –such as are spelled out in ILO Convention 169, the UN Draft Declaration on the Rights of Indigenous Peoples and other declarations, recommendations and resolutions by international bodies, suggest that States may undertake certain policies and activities to protect the cultural rights of indigenous peoples within the framework of the proposed Convention."
