Getting Divorced

If you are contemplating, or in the process of, obtaining a divorce, use these links to find information and resources about the legal process of divorce. There are also links to counselling and support resources to help you through what can be a difficult time. (Please note that the information provided here is not intended to replace professional legal counsel.)

Mediation
If you and your spouse are having difficulty finding common ground on issues such as child custody and division of assets, the Alberta Courts' Family Mediation Services may be able to help you come to an agreement without resorting to the courts.
Finding a Lawyer
You may want to hire a lawyer to help you through the legalities of the divorce process. If necessary, Legal Aid can help you find and pay for a lawyer.
Finding Your Own Legal Information
There are many resources available to help you do your own research about divorce. The Alberta government's Divorce Guide is available through the Queen's Printer or at many stationery/book stores in Alberta. You may also want to check out these links:

Ordering a Divorce Certificate
After your divorce, you may wish to order a Certificate of Divorce (Decree Absolute). You must have this certificate in order to remarry.
Changing Your Name
In Alberta, a woman who has assumed her husband's last name at marriage may at any time return to using the last name on her birth certificate. If you decide to do this, be sure to have your name changed on these government documents:
