The Act in Brief

Prince Edward Island enacted the Freedom of Information and Protection of Privacy Act on November 1, 2002. Now all provincial and territorial jurisdictions in the country have this type of legislation.

Pursuant to the Act, all public bodies are obliged to adopt a policy of accountability, openness and transparency and to provide a right of access to information, with limited exceptions. They are also obliged to ensure the protection of an individual's personal privacy.

The Commissioner conducts independent reviews of decisions of public bodies under the Act. If a matter cannot be settled between the parties, the Commissioner makes a final determination.
