Capture The Fun - Winter Photo Contest

Rules & Regulations

  1. The Contest Period starts at 12:01 a.m. Atlantic Time on February 5, 2007 and ends 11:59:59 p.m. Atlantic Time on April 18, 2007.  

    The Contest Period consists of a photo upload phase which begins at 12:00 a.m. Atlantic Time on February 5, 2007 and ends at 11:59 p.m. Atlantic Time on April 1, 2007 (the "Upload Phase"), and a voting phase which begins on April 4, 2007 at 12:00 a.m. Atlantic Time and ends on April 18, 2007 at 11:59 p.m. Atlantic Time ("Voting Phase"). Nova Scotia Tourism’s designated Administrator's computer is the official time keeping device for the contest. 
  2. Each week during the Upload Phase of the Contest Period, a random draw will be made by a representative of Nova Scotia Tourism from all eligible entries received up to the date of the weekly draw. The random draw will determine the weekly winner (one entrant will be selected per week) and the selected photograph will be featured on http://novascotia.com/capturethefun. Nova Scotia Tourism reserves the right to refuse to feature a selected photograph where in the opinion of Nova Scotia Tourism the photograph is objectionable or otherwise unsuitable.
  3. At the end of the Upload Phase, representatives from Nova Scotia Tourism will select the 20 Finalist Photographs from all eligible entries received up to the end of the Upload Phase and shall post the Finalist Photographs on http://novascotia.com/capturethefun. The judging will be based at the discretion of Nova Scotia Tourism, based on their assessment the photographs which best capture the joys of travelling in Nova Scotia. Nova Scotia Tourism’s judges’ rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.

    During the Voting Phase, visitors to the Website will be invited to cast one (1) vote for the Finalist Photograph the voter feels best captures the joys of travelling in Nova Scotia. Each visitor may vote one (1) time during the Voting Phase.

    On April 19, 2007, the Finalist Photograph with the highest number of votes will be declared the Final Grand Prize Winner. In case of a tie, Nova Scotia Tourism in its sole discretion will select the Grand Prize Winner based upon the photograph they deem to best represent the joys of travelling in Nova Scotia. Winners will be notified by email on or about April 19, 2007.

    The Final Grand Prize winner will receive a fleece blanket having a retail value of approximately $55.00.
  4. To enter go to www.novascotia.com, and complete the entry form in full and submit it in the format required by the website, along with a photograph taken of or in the province of Nova Scotia, and a short description of what the photograph is and where and when it was taken, before the end of the Upload Phase.
  5. Selected entrants will be contacted by email, as set out on the entry form. If a potential winner cannot be reached within five (5) days following the judges’ decision, another entrant will be selected at the earliest possible convenience.
  6. In order to win the prizes, entrants must first correctly answer, unaided, a time limited, a mathematical skill testing question, posed by telephone at a mutually convenient time.  In the event a selected entrant incorrectly answers the skill testing question, another entrant will be selected at the earliest possible convenience.
  7. NO PURCHASE NECESSARY.
  8. There is no limit to the number of entries per person so long as each entry is a distinctly different photograph from that previously entered.  Each photograph entry requires a separate entry form.  All entries become the property of Nova Scotia Tourism and will not be returned.
  9. Only the photographer has the right to submit a photograph, and the prizes will be awarded to the photographer.
  10. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Nova Scotia Tourism.
  11. Nova Scotia Tourism assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. Nova Scotia Tourism reserves the right, in their sole discretion, to cancel or suspend the email portion of this Contest should a virus, bug or other cause beyond the reasonable control of Nova Scotia Tourism corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should an attempt be made, Nova Scotia Tourism reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. 
  12. By submitting an entry form and/or accepting a prize, the entrant represents and warrants that (a) the photograph submitted is his or her original work and has not been copied in whole or in part from the other work; (b) the photograph submitted does not violate or infringe a copyright, trademark or other proprietary right of any person or legal entity; (c) the photograph submitted was taken at the location and time specified on the entry form, and (e) the subject(s) depicted in the photograph (if any) consent to its submission into the Contest and  use of the photograph as contemplated by these rules.  The entrant, by submitting an entry form and/or accepting a prize, agrees to indemnify Nova Scotia Tourism, and its agents, fully regarding any claims arising out of the use of his or her photograph(s).
  13. By submitting an entry form and/or accepting a prize, the entrant grants to Nova Scotia Tourism and/or its agents a worldwide, royalty-free license to the photograph(s) submitted to this Contest for all publicity and advertising related to tourism in Nova Scotia.  Winners and any persons appearing in the photograph(s) (if any), may be required to sign a release and indemnity form as provided by Nova Scotia Tourism releasing Nova Scotia Tourism from any liability in connection with the photographs submitted and the prizes awarded.  All entrants release Nova Scotia Tourism and its agents from any and all claims in relation to the Contest
  14. The odds of winning the Weekly Prizes depend on the number of entries received.
  15. All prizes must be accepted as awarded. Nova Scotia Tourism reserves the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prize.
  16. In order to win the prizes, entrants must first sign a release form as provided by Nova Scotia Tourism or its agents, consenting to the use of their personal information by Nova Scotia Tourism and/or its agents for publicity purposes.  All winning entrants must make him/herself available for the purpose of promotional photograph.
  17. The Contest is subject to all applicable federal, provincial and municipal laws and regulations. Nova Scotia Tourism reserves the right to modify or cancel this Contest at any time without notice to the entrants.
  18. Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcohols, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties to reach a settlement.
  19. THE CONTEST IS GOVERNED EXCLUSIVELY BY THE LAWS OF THE PROVINCE OF NOVA SCOTIA, CANADA, AND ALL DISPUTES ARE SUBJECT SOLELY TO THE COURTS OF NOVA SCOTIA WITHOUT REGARDS TO CONFLICTS OF LAW.
  20. By submitting an entry form and/or accepting a prize, the entrant consents to the entry of his or her submission and agrees to these Rules and Regulations.
