Zoning Official Plans,Zoning Bylaws and Rezoning Prince Edward Island has twenty-seven municipalities with Official Plans and Zoning Bylaws. The Planning Act guides the development of these documents. Official Plans An Official Plan sets out a municipality's general policies for future land use. Local government develops the Plan through consultation with the citizens of the community who help to ensure that future development will meet its needs. The Plan deals with issues such as location of new housing, industry and commercial offices as well as identifying essential services such as roads, sewers, parks and schools. These policies are implemented in a Zoning/Land Use Bylaw that provides for the day-to-day administration. Zoning Bylaw Zoning is the way in which the municipality regulates land development and the ways that individual properties may be used. Building height, set backs, yard size and lot frontage are development standards governed by zoning bylaws. A zoning map accompanies the bylaw that graphically shows how the lands withing the municipality are zoned. Rezoning Rezoning is a change to a zoning map. When a property owner proposes to develop or begin a use that the zoning map classification of the property does not allow, a rezoning may be appropriate. Rezoning applications are submitted to the municipalities who have an Official Plan and Zoning Bylaw. Municipal staff prepare an analysis and recommendation for consideration by Council or Planning Board. The council holds a public meeting to address concerns and gauge support. After the public meeting a decision to approve or deny the request is made.
