To Whom Does This Apply?

Manufacturers, importers, exporters, sellers and users of pesticides.

"Pests" include any injurious, noxious or troublesome insect, fungus, bacterial organism, virus, weed, rodent or other plant or animal pest, and includes any injurious, noxious or troublesome organic function of a plant or animal.

Summary

The Pest Control Products Act regulates products used for the control of pests and the organic function of plants and animals.

The Pest Control Product Regulations require that all pest control products imported into, sold or used in Canada or used or contained in another control product in Canada be registered. A "control product" is defined as any product, device, organism, substance or thing that is manufactured, represented, sold or used as a means for directly or indirectly controlling, preventing, destroying, mitigating, attracting or repelling any pest. It includes any compound or substance that enhances or modifies, or is intended to enhance or modify the physical or chemical characteristics of a control product to which it is added, and any active ingredient used for the manufacture of a control product. Certain controlled products are exempt from the Act.

An application for registration, or to amend an existing registration can be made to the Pest Management Regulatory Agency. A registration package can be ordered from the National contact listed below.  

The Regulations also specify the requirements for:

  • registration;
  • cancellation and suspension of registration;
  • prohibitions respecting use;
  • import;
  • export;
  • interprovincial trade;
  • record keeping;
  • labelling;
  • storage and display;
  • distribution and packaging;
  • standards; and
  • sampling and seizure of pesticide products.

Other federal and provincial legislation may apply to the transportation, spills and releases of pesticides. 

Each province has the power to regulate the sale of pesticides within the province, and to issue licenses, permits and certificates for the sale, distribution, and application of pesticides within the province. They can also regulate the storage and transport of pesticides within the province.
