Pilotage Tariff Proposals

The Pilotage Act created four pilotage authorities in Canada, each of which is Crown Corporation. A pilotage authority has the responsibility to administer an efficient system of marine pilotage in specified Canadian waters to ensure the safety of navigation. Each pilotage authority is empowered to impose pilotage charges on users that are to be fair and reasonable and which generate sufficient revenue to enable the pilotage authority to operate on a financially self-sufficient basis.

Summary

Each time a pilotage authority wishes to increase its pilotage charges, an amended pilotage tariff regulation containing the proposed increase must be published in the Canada Gazette Part I. Following the publication of a tariff proposal, any person who believes that the proposed tariff is prejudicial to the public interest may file an objection with the Agency. All objections must be filed within 30 days of the date of the publication of the tariff proposal in the Canada Gazette. Under provisions of the Canada Marine Act, the filing of an objection does not prevent the new tariff from coming in effect 30 days after publication.

Once an objection to a pilotage tariff proposal has been filed, the Agency must carry out an investigation of the tariff proposal and render, within 120 days, a decision on whether or not it is prejudicial to the public interest. A pilotage authority must abide by the Agency ruling. The Agency is to provide the Minister of Transport with a copy of its ruling.
