Creating a Non-profit Corporation or Organization

What is a non-profit corporation or organization?

A non-profit corporation is a group of at least three (3) persons (members) who are the applicants and temporary directors.

The corporation engages in non-profit cultural, social, philanthropic, national, patriotic, religious, charitable, scientific, artistic, professional, athletic, sports, educational or other activities.

The forms must be printed or typewritten, legible and suitable for microfilming and photocopying.

Creating a non-profit corporation or organization

Procedure

Step 1: Obtain a Name Research Report or name reservation.

If paying by credit card, you can fax the form to 514 873-8445.

Step 2: Submit the documents.

  • Copy of the Name Research Report and if applicable, confirmation of a name reservation;
  • Application for Constitution as a Non-profit Legal Person form;
  • Required payment.

Processing your application

If your application is approved, the letters patent will be sent to you and the enterprise registrar will register the non-profit corporation by filing a copy of the letters patent in the register.

An Initial Declaration produced within 60 days following the filing of your letters patent in the register is free; otherwise a fee is charged.

Once the non-profit corporation is registered, you have legal obligations to fulfill under the Act Respecting the Legal Publicity of Sole Proprietorships, Partnerships and Legal Persons.
