The Environmental Protection Division regulates the introduction of waste into the environment under the Environmental Management Act(EMA).

Under the EMA only introductions of waste from ?prescribed? industries, trades, businesses, operations and activities require authorization. Industries, trades, businesses, operations and activities are ?prescribed? via the Waste Discharge Regulation. If an industry, trade, business, activity or operations is not ?prescribed? by the regulation they do not require an authorization to introduce waste into the environment; however, they must not cause pollution EMA section 6(4).

Water Licence Application and Approval:

All water in British Columbia is owned by the Crown on behalf of the residents of the province. Authority to divert and use surface water is obtained by a licence or approval in accordance with the statutory requirements of the Water Act and the Water Protection Act .

In British Columbia, simply having access to surface water within or adjacent to property does not authorize a right to divert, use or store water.
