Subsection 16(4) of the Customs Tariff (NAFTA Chapters 3 and 4) and subsection 164(1.1) of the Customs Act (NAFTA Chapters 3 and 5) allow for the creation of regulations that ensure the uniform interpretation, application and administration of the rules of origin under NAFTA and any other matter that may be agreed on from time to time by the NAFTA countries.
The NAFTA Rules of Origin Regulations set out the conditions under which goods may qualify for a NAFTA preferential tariff treatment. (There are 3 preferential tariff treatments under the NAFTA.) These regulations are uniform in the three countries with a few minor exceptions.
