Overview:
This Act regulates contracts for the prepayment of funeral services. It requires licensing of funeral directors who offer pre-arranged funeral contracts and specifies that funds held under such a contract be held in a trust account that is monitored by the Consumer Affairs Branch. The Act provides cancellation rights and maximum penalties that can be charged for the cancellation of a pre-arranged funeral service contract. This Act also contains provisions for the Compensation Fund, which exists to reimburse consumers in case of a monetary loss. Penalties are provided under this legislation for non-compliance.
 
Eligibility:
Pre-arranged Funeral Services licences are available through the Consumer Affairs office. Applicants must prove that they are licensed by the Funeral Directors and Embalmers Association of New Brunswick. All applications must be accompanied by a copy of the contract to be used with consumers for verification, as well as the potential licensee's Trust Agreement with a financial institution.
