Rubin Kimmel Enters Guilty Plea For Humane Transport Violation

Winnipeg, Manitoba: On April 10th, 2013, in Manitoba Provincial Court, Mr. Rubin Kimmel of Dugald, Manitoba, entered a guilty plea to one count of contravening Subsubsection 140(2) of the Health of Animals Regulations.

In his decision, the Honourable Judge Finlayson accepted a joint recommended sentence of a conditional discharge and ordered Mr. Kimmel to enroll, and successfully complete either the Transport Quality Assurance certification course or the Canadian Livestock Transport certification course and provide proof of completion to either course to Probation Services.

Subsection 140(2) of the Health of Animals Regulations states:

“No person shall transport or cause to be transported any animal in any railway car, motor vehicle, aircraft, vessel, crate or container that is crowded to such an extent as to be likely to cause injury or undue suffering to any animal therein.”

A Canadian Food Inspection Agency (CFIA) investigation determined that on or about June 18, 2009, Mr. Kimmel did transport animals, namely 220 market hogs, in a motor vehicle that was crowded to such an extent as to cause injury or undue suffering to the animals.
