BioFert Manufacturing Ltd. enters guilty plea for Fertilizer Act contravention

October 11, 2013, Chilliwack: On August 9, 2013, in Chilliwack Provincial Court, BioFert Manufacturing Ltd. entered a guilty plea to one count of contravening Section 3 of the Fertilizers Act.

The Honourable Judge Cutler accepted the joint recommended sentence and imposed a fine of $3,500 against BioFert Manufacturing Ltd.

Section 3 of the Fertilizers Act reads:

3. No person shall sell, or import into Canada, any fertilizer or supplement unless the fertilizer or supplement

  1. has been registered as prescribed;
  2. conforms to prescribed standards; and
  3. is packaged and labelled as prescribed.

A Canadian Food Inspection Agency (CFIA) investigation determined that on September 28, 2011, BioFert Manufacturing Ltd. sold four 25kg bags of unregistered "Iron EDTA" to a British Columbia nursery.

This was after a prior agreement between the CFIA and BioFert Manufacturing Ltd. that the product would only be used in the manufacturing of BioFert product and would not be offered for sale.

The CFIA enforces federal legislation, including the Fertilizer Act.
