1. REGISTERING A NON-PROFIT ORGANIZATION

Non-profit organizations in Nova Scotia may wish to register as a Society.  The process requires name reservation which involves a name search performed by the Registry of Joint Stock Companies.  The name search is free for Societies.  Once it is determined that the name you have chosen is available, it will be reserved for 90 days.  It is during this time that you will be able to register your non-profit organization as a Society.

Once the name has been reserved, all of the required Society Registration Forms must be completed. The forms can be obtained online. The completed forms are then submitted to the Registry of Joint Stock Companies with the $35 fee. There will also be an annual renewal fee of $25 for Societies.

Federal Not-For-Profit Incorporation - Canada Corporations Act / Part II - Industry Canada

Non-profit organizations can be incorporated at the federal level under the Canada Corporations Act, Part II.  This includes both charitable corporations and membership corporations, such as social, professional or fraternal organizations.

The following documents must be submitted to the Corporations Directorate in order to obtain a Letters Patent of Incorporation:

  • an application for Letters Patent, in duplicate
  • an affidavit or statutory declaration
  • a $200 filing fee
  • a current Canada-based NUANS name search report
  • one copy of the proposed bylaws
  • a covering letter stating the street address of the corporations head office

Information on Charities - Canada  Revenue Agency

Through the Charities Tax Incentive which gives Canadians tax relief when they give to charity, the government supports the charitable community in Canada.  To qualify for registration, an organization must be established and operated for charitable purposes, and it must devote its resources to charitable activities.  The charity must be resident in Canada, and cannot use its income to benefit its members.

Registration gives an organization three main advantages:

  • it can issue official donation receipts for gifts received
  • it is exempt from paying income tax
  • it may qualify for a HST rebate

Business Development Program - Non-Commercial Projects - Atlantic Canada Opportunities Agency

Non-commercial/not-for-profit organizations, including Aboriginal organizations, such as business and economic development associations, provincial crown corporations, universities, educational institutions, municipalities and their agencies, business or technology institutes are eligible.  The proposed project must provide a service to business in areas such as entrepreneurship development, marketing, training or technology transfer.

Canada Foundation for Innovation- Industry Canada

The Foundation's goal is to strengthen the capability of Canadian universities, colleges, research hospitals, and other non-profit institutions to carry out world-class research and technology development.

Cape Breton Growth Fund - Cape Breton Growth Fund Corporation

The objective of the Cape Breton Growth Fund (CBGF) is to promote sustainable long term economic development for Cape Breton Island by both commercial and non-profit organizations.  Funding will only be available in priority areas which include; oil and gas, tourism development, environmental remediation, arts and culture development, infrastructure, and knowledge-based sectors.

Community ACCESS-Ability - Service Nova Scotia and Municipal Relations

The Community ACCESS-Ability Program improves access to community facilities and venues for persons with disabilities by providing financial assistance in the form of a cost-sharing grant for accessibility-related capital improvements.  Eligible projects may include: ramps, barrier-free washrooms, power door operators, and audio signals.

Contributions Program for Non-Profit Consumer and Voluntary Organizations - Industry Canada

The program provides consumer and voluntary organizations with the means to produce high quality and timely research on consumer issues affecting the marketplace, and to develop policy advice on these issues that are both credible and useful to decision-makers.

EcoAction - Community Funding Program - Environment Canada

EcoAction encourages projects that protect, rehabilitate or enhance the natural environment, and build the capacity of communities to sustain activities into the future.  Non-profit, non-government groups can apply for funding.

Halifax Regional Municipality Community Grants Program - Halifax Regional Municipality

The Community Grants Program provides annual cash grants to non-profit community groups located in the Halifax Regional Municipality.  These awards support community volunteers and non-profit groups in the arts, social, cultural, recreational, heritage and environment programs.  The application deadline is generally January 31st each year.

Student Employment Program - Nova Scotia Office of Economic Development

The Provincial Employment Program (SEP) offers summer wage subsidy programs to non-profit organizations who employ full-time students (college/university students or high school graduates) attending a post-secondary institution in September.

Cooperative Employment Program - Nova Scotia Economic Development

The Co-operative Employment Program is a wage subsidy program available to government funded organizations, municipal governments and non-profit organizations.  Eligible employers hire students from approved co-operative programs and are reimbursed for part of the student's wages.

Surplus Government Assets for Non-Profit Organizations - Nova Scotia Department of Transportation and Public Works

Surplus Crown property becomes available whenever government departments, agencies, boards or commissions declare their property surplus to their requirements.  At this time, these surplus assets may be provided at nominal or no cost to eligible non-profit organizations.

3. TAXATION

GST/HST Rebates for Public Service Bodies - Canada Revenue Agency

Many goods and services provided by public service bodies are exempt from GST/HST. These bodies can get back some of the GST/HST they paid on items they used to either make the goods or to provide the services.

Non-profit Organization - NPO - Information Return - Canada Revenue Agency

As required by subsection 149(12) of the Income Tax Act, your organization may have to file the Non-Profit Organization (NPO) Information Return if it is an agricultural organization, a board of trade, a chamber of commerce, a club, society, or association that is organized and operated solely for:

  • social welfare
  • civic improvement
  • pleasure or recreation
  • any other purpose except profit
