Legal authorities under which the GHG data are collected include:

LEGAL AUTHORITIES

In order to avoid duplication and to ease response burden, Statistics Canada will jointly collect the information under the authority of the Statistics Act, Revised Statues of Canada 1985, c.S-19, as well as under the authority of the Canadian Environmental Protection Act, 1999 (Canada) and the Climate Change Emissions Management Act (Alberta). Completion of this report is a legal requirement under these Acts.

Under the provisions of Section 12 of the Statistics Act, Statistics Canada has entered into data sharing agreements, whereby the collected information will be provided to Environment Canada and Alberta Environment. This information is being collected by Statistics Canada for statistical and research purposes, by Environment Canada pursuant to CEPA 1999 and by Alberta Environment pursuant to the Climate Change and Emissions Management Act and the Specified Gas Reporting Regulation.

CONFIDENTIALITY

Statistics Canada is prohibited by law from divulging information collected for its own purposes, that relate to any identifiable business, without the previous written consent of the business. The information being collected for Statistics Canada will be treated in strict confidence, used for statistical purposes and will only be published in aggregate form, in accordance with the Statistics Act. The confidentiality provisions of the Statistics Act are not affected by either the Access to Information Act or any other legislation.

Environment Canada will release the collected information to other government organizations and the public in general, in accordance with the provisions of the Canadian Environmental Protection Act, S.C. 1999, c. 33 (CEPA). For facilities in Alberta, the information may also be released in accordance with the Climate Change Emissions Management Act, S.A. 2003, c. C-16.7 and the Specified Gas Reporting Regulation. Reporters can request that their information be treated as confidential by Environment Canada and Alberta Environment.
