Chemical Substances in Batch 2 of the Challenge

On May 12, 2007, the Minister of the Environment and the Minister of Health released a Notice in the Canada Gazette on the second group of substances identified under the Challenge, entitled: Notice of second release of technical information relevant to substances identified in the challenge. Industry and interested stakeholders are invited to submit any information that may be used to inform risk assessment and to develop and benchmark best practices for risk management and product stewardship.

Section 71 Survey Notice

The following Notice, issued under section 71 of the Canadian Environmental Protection Act, 1999, entitled: Notice with respect to certain Batch 2 Challenge substances applies to 15 of the 17 substances in the second group identified under the Challenge. A previous Notice requiring information included two of the 17 substances (CAS No. 732-26-3 and 15086-94-9) and provided sufficient information not to warrant their inclusion in the current Notice.

Every person to whom the Notice applies must comply with the Notice by no later than 3:00 p.m. EDT, September 12, 2007. Please note that under subsection 71(4) of the Act, extensions for a maximum of two months may be granted in some cases upon written request. To apply for an extension, a written request and justification must be received by the Minister of the Environment prior to the deadline.

Questionnaire

In addition, Industry and interested stakeholders are also invited to submit, within six months (on or before November 13th, 2007), further information regarding the scientific properties of these substances, or best management practices associated with the use of these substances that might contribute to improved decision-making. Information on the type of information that could be submitted, and logistics for submitting information is detailed in the Challenge Questionnaire and related Guidance Document below.

Timelines

12 September 2007 Deadline for submission of information under the section 71 notice on "batch 2" substances (if no extension granted)
13 November 2007 Deadline for submission of additional information by interested stakeholders, including on the extent and nature of the management/stewardship of "batch 2" substances.
No later than 16 February 2008 If no information received:
Publication in Canada Gazette and start of 60-day public comment period on (a) the draft screening assessment, and (b) the proposal to pursue one of the measures as specified under subsection 77(2)
No later than 17 May 2008 If specified information is received:
Publication in Canada Gazette and start of 60-day public comment period on (a) the draft screening assessment, (b) the new information received, and (c) the proposal to pursue one of the measures as specified under subsection 77(2)
No later than 16 August 2008 When no information is received during challenge period:
Publication in Canada Gazette of final assessment recommendation under subsection 77(6) and release of risk management approach
No later than 22 November 2008 When information is received during challenge period:
Publication in Canada Gazette of final assessment recommendation under subsection 77(6) and release of risk management approach

Information Workshops for Stakeholders

Environment Canada and Health Canada hosted workshops in Toronto on June 7, 2007 and in Calgary on June 12, 2007, to help further explain to stakeholders the Challenge, the associated documentation and how to participate. It should be emphasized that the objectives of the workshop were for federal officials to provide details on what information is being sought for the Challenge, how participants are to submit this information, and the associated timelines. Discussion focused on the documents associated with the Challenge which are provided on this website.

Environment Canada and Health Canada will consider hosting similar information workshops for stakeholders in late September or early October 2007, following the launch of Batch 3 of the Challenge, should the number of requests received from interested stakeholders warrant this.
