Summary

The Employment Standards Act offers minimum employment rules on such things as minimum wage, overtime pay, vacations with pay, and sick leave. For more information, check out our fact sheets at:  http://www.gnb.ca/0308/001-e.asp.

Our mission is to promote, oversee and enforce the application of the Employment Standards Act in New Brunswick. Our branch is a neutral party providing comprehensive services to both employees and employers. The services offered by this branch range from responding to general inquiries to providing pro-active services to the public.

The Employment Standards Act serves all New Brunswick employees and employers who come within provincial jurisdiction. Employees governed by a collective agreement must avail themselves of the grievance process under their agreement rather than placing a complaint under the Employment Standards Act. Collective agreements cannot provide for lesser benefits than those contained under the Employment Standards Act .

Employees and employers who fall within federal jurisdiction are governed by the Canada Labour Code. 

Minimum wage in New Brunswick:

As of January 1st, 2007:  $7.00 per hour.

As of July 1st, 2007:  $7.25 per hour.

As of March 31st, 2008:  $7.75 per hour.
