To Whom Does This Apply?

The Collection Agencies Act applies to professional bill collectors and collection agencies.

Summary

The purpose of the Act is to provide protection for debtors against harassment or other undesirable activities of professional bill collectors. The Act also provides for protection and accountability of funds held by collection agencies.

Each collection agency and each individual collector must obtain a licence from Consumer Affairs.

Business records must be available for inspection in the province.

The agency must provide a bond in the amount of $10,000 issued by an insurance company.

Agency licences cost $300 for up to three collectors and $500 if over three collectors, plus $100 for each branch location within New Brunswick.

A collector´s licence costs $25.

All licences expire on October 31st of each year regardless of date of issue.

Consumer Affairs officers will investigate complaints about the activities of collectors and agencies. Written complaints are preferred but immediate action will be taken on verbal complaints if it appears necessary. Disciplinary hearings can be held and licences suspended or cancelled.
