Summary

The purpose of the Appeals Tribunal is to hear and determine appeals from workers, dependents and/or employers under the Workers' Compensation Act or the Occupational Health and Safety Act.

The Appeals Tribunal can only consider appeals from any written decision of an officer of the Commission.

The Appeals Tribunal can consider an appeal through an Appeals Panel Hearing. An Appeals Panel consists of a three-person Panel or a single-person Panel. A three-person Panel is made up of a Chairperson and two members of the Appeals Tribunal, one from the workers’ community and one from the employers’ community. However, members of an Appeals Panel must act on an impartial basis and as such, do not represent any particular group.  A single-person Panel is subject to the consent of all parties and is made up of the Chairperson or a vice-chairperson of the Appeals Tribunal.

An oral presentation is a hearing at which the Appeals Panel (three-person or a single-person Panel) meets with the person submitting the appeal, other parties involved and respective representatives.

A paper review is a hearing where the Appeals Panel (three-person Panel) reviews the Appeal Record and any written submissions.

The decisions of the Appeals Tribunal are delivered in writing and are based on the Appeal Record, oral information and/or written submissions.  All decisions of the Appeals Tribunal are final and are appealable on a question of law or jurisdiction to the Court of Appeal.
