To Whom Does This Apply?

All persons removing topsoil in New Brunswick.

Summary

All persons removing topsoil to the following undertakings or developments are required to obtain a Topsoil Removal Permit prior to the removal of such topsoil. 

  • the development of land for the purposes of growing cranberries;
  • the construction of a private road;
  • the construction of any building or structure, other than a residential building or structure located on a parcel that is one hectare or less in area;
  • the construction of a loading facility, parking facility or driveway other than a driveway for a residential structure located on a parcel that is one hectare of less in area.
