THE MANITOBA FILM CLASSIFICATION BOARD ORDER
OF EXEMPTION, GENERAL

It is ordered that:

The following classes of film categories listed below under "Exempt Categories" for Home-Use may be exempt, subject to conditions of Exemption, from the following provisions of the Amusements Act and regulations: Section 16.1, 16.3 and 20(2) of regulation 489/88.

Conditions of Exemption

For each film title to be submitted:

If the answer to all questions listed below is "NO" a distributor is not required to submit the film for classification and the film is considered exempt. If the answer is "YES" to any one question then the film is not exempt and must be submitted to the Manitoba Film Classification Board for classification. Distributors are advised to err on the side of caution if the answer is "maybe."

Does the Program contain any of the following?

Note: the words human or animal mean real images and animated or digitized human or animal-like characters.

1. Violence towards humans or animal characters.
2. Physical or physiological abuse or humiliation.
3. Blood or gore.
4. Depictions of death or injury to humans or animal characters.
5. Derogatory, ethnic, racial, religious or nationalistic stereotypes or symbols.
6. Course language.
7. The use of drugs, or encouraging the use of alcohol or tobacco.
8. Offensive gestures.
9. Graphic depictions of urination, defecation or vomiting.
10. Techniques likely to be useful in the commission of crime.
11. Nudity.
12. Sexual images or references (suggested or real).

Exempt Categories

1. Cultural films which portray artistic subjects such as music, ballet, dance, opera, or the moral, philosophical, social, economic, ethnic, or religious roots of a people or race;
2. Heritage films which describe the history of individuals or a people;
3. Religious films which represent religious attitudes, beliefs or practices of various ethnic groups in Canada, but not including religious films exhibited or distributed for direct or indirect gain;
4. Children's cartoons which are of an animated nature ordinarily produced for children's programming on television, but not including pornographic films bearing children's titles;
5. Travelogue films which present a tour of a continent, country or place;
6. Political films used to promote political goals of traditional political parties, but not including films that advocate terrorism, anarchy, treason or racism;
7. Industrial and business films used to promote the sales of products or to inform persons about industrial or technological machinery or methods;
8. Sporting event films used to present actual athletic events which are traditionally presented in the written or electronic media and in which the participants belong to recognized leagues or sports organizations;
9. Educational films used for instructional purposes in colleges, universities, schools, libraries, or similar educational institutions;
10. "How-to" films which provide information or instruction for self-improvement or home improvement;
11. Exercise films which provide educational and instructional material related to exercise;
12. Arcade games;
13. Films designed for use as an integral part of a concert or theatrical stage production;
14. Films previously broadcast or transmitted in Manitoba by free over-the-air radio waves or by cable or satellite as part of basic service as defined in the Broadcasting Distribution Regulations under the Broadcasting Act (Canada);
15. Music videos that are filmed or videotaped renditions of recorded songs, often portraying musicians performing the song or including visual images interpreting the lyrics.

The Board reserves the right to request titles for review from time to time that are exempt under this order.
