Rates of Pay for Certain Excluded and Unrepresented Employees

Policy statement

The rates of pay for excluded and unrepresented employees in those parts of the Public Service listed in Part I of Schedule I of the Public Service Staff Relations Act (PSSRA) are established by the Treasury Board pursuant to section 11 of the Financial Administration Act (FAA).

When persons are employed in a managerial or confidential capacity in an occupational group and level covered by a collective agreement and their rates of pay have not been specified by the Treasury Board, they will be paid at the rates of pay set out in the relevant collective agreement.

Certain collective agreements have provided for lump sum payments to employees in lieu of retroactive salary increases or as settlement bonuses. Unless otherwise directed by the Treasury Board, such lump sum payments are also to be paid to employees who are excluded from the collective agreement as managerial or confidential exclusions, although they are classified in an occupational group or level which is covered by the collective agreement.

Publication of rates of pay

Generally, the rates of pay for excluded and unrepresented employees are published in this document. When the rates of pay and salary administration instructions for excluded employees are identical to those of non-excluded employees, they appear in the relevant collective agreements.

The rates of pay for employees subject to collective bargaining appear in the collective agreements.

Progression of salaries beyond a salary barrier subject to certification of qualifications - Authority to certify

Certain groups and levels have pay scales or ranges in which there are barriers beyond which the salary of an employee may progress only after certification that the employee has attained the required qualifications.

The responsibility for determining the qualifications of an individual for appointment to a position in the Public Service is vested in the Public Service Commission. Where authority to staff positions has been delegated by the Commission to the deputy head of a department, the deputy head is responsible for determining an individual's qualifications and for certifying that the employee has attained the required qualifications.

PAY NOTES

  1. Effective January 26, 2001, prior to any other pay revision which occurs on that date, an employee shall be paid in the "A" scale of rates at the rate of pay which is immediately higher than the employee's rate of pay on January 25, 2001.
  2. Where an employee is performing acting duties on January 26, 2001, and is paid acting pay, the acting rate of pay will be adjusted effective January 26, 2001, in accordance with Pay Note 1. Upon termination of the acting assignment, the employee's substantive rate of pay will then be adjusted in accordance with Pay Note 1.
  3. The pay increment period for employees is one (1) year and a pay increment shall be to the next higher rate in the scale of rates.
  4. Subject to Pay Note 5, the pay increment date for an employee appointed to a position on promotion, demotion or from outside the Public Service after February 22, 1982, shall be the anniversary date of such appointment. The anniversary date for an employee who was appointed to a position prior to February 22, 1982 remains unchanged.
  5. Part-time employees shall be eligible to receive a pay increment when the employee has worked a total of nineteen hundred and fifty (1950) hours at the hourly rate of pay during a period of employment provided that the maximum rate for the employee's level is not exceeded. The pay increment date shall be the first working day following completion of the hours specified in this paragraph.

Retroactive Period

  1. The rates of pay shall become effective on the dates specified.
  2. "Retroactive period" means the period from the effective date of the revision up to and including the day before the rates were promulgated.
  3. A retroactive upward revision in rates of pay shall apply to employees, former employees or in the case of death, the estates of former employees who were employees in the group during the retroactive period.
  4. Initial appointments made during the retroactive period, the rate of pay selected in the revised rates of pay is the rate, which is immediately below the rate of pay being received prior to the revision.
  5. Promotions, demotions, deployments, transfers or acting situations effective during the retroactive period, the rate of pay shall be recalculated, in accordance with the Public Service Terms and Conditions of Employment Regulations, using the revised rates of pay. If the recalculated rate of pay is less than the rate of pay the employee was previously receiving, the revised rate of pay shall be the rate of pay immediately below the rate of pay being received prior to the revision.
  6. No payment or no notification shall be made for one dollar ($1.00) or less.

PAY NOTES

An employee being paid at Level AS-7, or AS-8, shall have his or her rate of pay increased:

  1. On June 21, 2003, to a rate within the 'A' performance pay range which is two point five percent (2.5%) higher than his or her former rate of pay, rounded to the nearest multiple of one hundred dollars ($100).
  2. On June 21, 2004, to a rate within the 'B' performance pay range which is two point two five percent (2.25%) higher than his or her former rate of pay, rounded to the nearest multiple of one hundred dollars ($100).
  3. On June 21, 2005, to a rate within the 'C' performance pay range which is two point four percent (2.4%) higher than his or her former rate of pay, rounded to the nearest multiple of one hundred dollars ($100).
  4. On June 21, 2006, to a rate within the 'D' performance pay range which is two point five percent (2.5%) higher than his or her former rate of pay, rounded to the nearest multiple of one hundred dollars ($100).

Pay Notes

  1. Employees who have been at the maximum rate of pay for their level for twelve months or more on June 22, 2003, will move to the new maximum rate of pay effective June 22, 2003; and
  2. Employees who were at the 1st step of the pay range on June 22, 2003 will move to the next higher rate of pay on June 22, 2003.

Pay Notes:

Pay Adjustment Administration

  1. The pay increment period for employees paid in these scales of rates is twelve (12) months.
  2. An employee shall, on the relevant effective dates of adjustments to rates of pay, be paid in the (A), (B), (X) or (C) scale of rates at the rate shown immediately below his former rate.
  3. All other terms and conditions of employment provisions of the new CS collective agreement apply to the excluded CS-5s including: the $ 300 bonus; a one-time entitlement of 37.5 hours of vacation leave with pay to replace marriage leave provision (see contract paragraph 15:19); and a terminable allowance of $ 285 per month which will cease as of December 20, 2006 (see contract appendix D).

Employees Transferred from the Canada Revenue Agency

  1. Effective December 22, 2004, should the employee's salary be within the new salary band in the A line, the employee's new rate of pay shall be the step in the A line which is closest to, but not less than, the rate of pay received on that day. Furthermore, the employee shall be entitled to a lump sump in an annualized amount equivalent to the difference between the value of the economic increase (i.e. 2.25%) and the actual salary increase, to be paid bi-weekly.
  2. Should the employee's salary exceed the maximum of the range for his/her group and level, the employee's salary shall remain unchanged until such time as the maximum rate of pay for the employee's group and level is equal to, or greater than, the employee's salary.
  3. Effective December 22, 2004, employees who continue to be subject to paragraph (b) shall receive a lump sump payment in an annualized amount equivalent to 2.25% of the employee's rate of pay, to be paid bi-weekly, in lieu of the economic increase.
  4. Effective December 22, 2005, should the employee's salary be within the new salary band in the B line, the employee's new rate of pay shall be the step in the B line which is closest to, but not less than, the rate of pay received on that day. Furthermore, the employee shall be entitled to a lump sum in an annualized amount equivalent to the difference between the value of the economic increase (i.e. 2.4%) and the actual salary increase, to be paid bi-weekly.
  5. Effective December 22, 2005, employees subject to paragraph (b) shall receive a lump sum payment in an annualized amount equivalent to 2.4% of the employee's rate of pay, to be paid bi-weekly, in lieu of the economic increase.
  6. Effective December 21, 2006, should the employee's salary be within the new salary band in the X line, the employee's new rate of pay shall be the step in the X line which is closest to, but not less than, the rate of pay received on that day. Furthermore, the employee shall be entitled to a lump sum payment in an annualized amount equivalent to the difference between the value of the flat rate increase (i.e. $900) and the actual salary increase, to be paid bi-weekly.
  7. Effective December 21, 2006, employees subject to paragraph (b) shall receive a lump sum payment in an annualized amount equivalent to $900, to be paid bi-weekly, in lieu of the flat rate increase.
  8. Effective December 22, 2006, should the employee's salary be within the new salary band in the C line, the employee's new rate of pay shall be the step in the C line which is closest to, but not less than, the rate of pay received on that day. Furthermore, the employee shall be entitled to a lump sum payment in an annualized amount equivalent to the difference between the value of the economic increase (i.e. 2.5%) and the actual salary increase, to be paid bi-weekly.
  9. Effective December 22, 2006, employees subject to paragraph (b) shall receive a lump sum payment in an annualized amount equivalent to 2.5% of the employee's rate of pay, to be paid bi-weekly, in lieu of the economic increase.
  10. All other terms and conditions of employment provisions of the new CS collective agreement apply to the excluded CS-5s including: the $ 300 bonus; a one-time entitlement of 37.5 hours of vacation leave with pay to replace marriage leave provision (see contract paragraph 15:19); and a terminable allowance of $ 285 per month which will cease as of December 20, 2006 (see contract appendix D).

  1. Pay increment (applicable to all employees) Every twelve (12) month period, on the anniversary of his or her hiring date, the employee shall advance to the next increment.
  2.
