This panel hears appeals from
people who have requested home care services and disagree with the
decisions made regarding their eligibility or level of service.
The panel is independent of Manitoba Health and has three
important goals:
Home care recipients and potential recipients are
assured a fair independent hearing of their concerns.
The Minister of Health will receive impartial
advice and recommendations.
Uniform criteria and policies will be applied
throughout the province.
When Can I Appeal a Decision?
You can file an appeal if:
-
your request for home care service was denied;
-
you disagree with the level of service you receive; or
-
you have concerns regarding any aspect of the home care
services you are receiving.
Who Can File An Appeal?
-
Manitobans who are currently using home care or have
applied for home care may file an appeal at any time.
-
Family members, friends, primary care-givers or other
providers may file an appeal when they have the home care user's consent.
How Do I File My Appeal?
The Appeal Panel encourages you to contact your Home Care
office first to discuss your concerns.
If you are unable to resolve your concerns with the Home
Care office, you may file an appeal directly with the panel.
Steps to filing an appeal:
Contact the Appeals office to request an appeal
form, or download the form here in Adobe
Acrobat format. (If you do not have the Adobe Acrobat reader
installed on your computer, please click
here.)
Fill out this form and return it to the Appeals
office. If you have any questions about how to fill out the
form, please call an Appeals officer at 788-6788
or toll free at 1-800-491-4993 or by
e-mail.
If you are unable to fill out the form, appeals
will be accepted and confirmed by telephone. Appeals office
staff will assist you in this process.
How Does the Appeal Process Work?
Appeals are reviewed and processed on a timely basis.
When your appeal form is received, you will be sent a Notice of Hearing.
This notice will tell you the date and location of your
hearing. Appeal hearings are informal and confidential.
Who Attends the Appeal Hearing?
You have several options:
You may attend the
hearing yourself.
You may send a support
person or designate to represent you if you cannot attend the
hearing in person.
You may participate in
the hearing by telephone if the first two options are not possible.
The hearing will also be attended by:

a minimum of three Appeal Panel members;
-
Appropriate Home Care staff; and
-
Appeals office staff who have been working with you on
your appeal.
How Will I Know the Result of the
Hearing?
When a decision is reached on your appeal, you and the
Regional Health Authority will receive notice in the mail. The
decision of the Appeal Panel is final.
